ПОДСЪДИМИЯТ Д.К.Д., със снета самоличност, СЕ ПРИЗНАВА ЗА ВИНОВЕН в това, че през периода от 28.09.2007 година до 12.07.2011 година в град Стара Загора възпроизвеждал върху дисковото пространство на асемблирана компютърна система – сървърна конфигурация „COOLER MASTER”, чужди обекти на авторско право и сродни на него права, а именно видеозаписи, звукозаписи, аудиовизуални произведения /видеоклипове/, компютърни програми и компютърни игри, както следва:

СТРАНИТЕ се съгласяват на подсъдимия Д.К.Д. за извършеното престъпление на основание чл.172а, ал.1 във връзка с чл.55, ал.1, т.2, буква „б” във връзка с чл.42а, ал.2, т.1 и т.2 във връзка с ал.3, т.1 във връзка с ал.1 във връзка с чл.42б, ал.1 и ал.2 от НК да му бъде наложено наказание „ПРОБАЦИЯ” със следните пробационни мерки:

1.„Задължителна регистрация по настоящ адрес” за срок от ШЕСТ МЕСЕЦА с периодичност ДВА ПЪТИ СЕДМИЧНО.

2.„Задължителни периодични срещи с пробационен служител” за срок от ШЕСТ МЕСЕЦА.

СТРАНИТЕ се съгласяват на основание чл.55, ал.3 от НК на подсъдимия да не СЕ НАЛАГА по-лекото наказание „ГЛОБА”, което законът предвижда наред с наказанието „Лишаване от свобода”.

СТРАНИТЕ се съгласяват, че направените по делото съдебни и деловодни разноски в размер на 426,00 лева /четиристотин двадесет и шест лева/ ще бъдат заплатени от подсъдимия.

НА ОСНОВАНИЕ чл.55, ал.3 от НК НЕ НАЛАГА на подсъдимия Д.К.Д., с п.с, по-лекото наказание „Глоба”, което законът предвижда наред с наказанието „Лишаване от свобода”.

НА ОСНОВАНИЕ чл.53 от НК във връзка с чл.112 от НПК ПОСТАНОВЯВА вещественото доказателство по делото – асемблирана сървърна компютърна система, в черна на цвят кутия, с надпис на предния панел „COOLER MASTER”, иззета с протокол за претърсване и изземване от 12.07.2011 година, намираща се на съхранение в РЗ „БОП” – Стара Загора, намираща се на съхранение в РЗ „БОП” – Стара Загора, да се отнемЕ в полза на Държавата.

НА ОСНОВАНИЕ чл.112 от НПК ПОСТАНОВЯВА вещественото доказателство по делото – асемблирана компютърна система, в синьо - бяла на цвят кутия, с надпис на предния панел „DIGITAL MULTIMEDIA COMPUTER SYSTEM”, иззета с протокол за претърсване и изземване от 12.07.2011 година, намираща се на съхранение в РЗ „БОП” – Стара Загора намираща се на съхранение в РЗ „БОП” – Стара Загора, ДА СЕ ВЪРНЕ на собственика Д.К.Д., ЕГН **********.

ОСЪЖДА подсъдимия Д. ***, ДА ЗАПЛАТИ в полза на Държавата по сметка на Районен съд – Стара Загора сумата от 426,00 лева /четиристотин двадесет и шест лева/, представляваща направените по делото съдебни и деловодни разноски.
